AGREEMENT

A binding agreement between Cracker Catering and the Client is effective upon receipt of a signed quotation from the Client. Booking confirmation is subject to availability. By signing and returning the quotation form the Client agrees to adhere to all the listed terms and conditions, which are located below on our website. 

PAYMENT

All clients booking catering, functions, or hospitality packages are required to pay 50% deposit upon booking and balance of payment is due, with final guest numbers, 7 days prior to the event. Payment can be in the form of EFT or Paypal.

Failure to pay in full for a catering package within 7 days of your function may result in Cancellation of the Clients booking and forfeit of any payments made. 

CANCELLATION

If you wish to cancel your booking with Cracker Catering, we will require written notification and following will apply.

-  If cancellation occurs within 1 month or more from the event date, 75% of the deposit will be

refunded, along with any other payments

-  If cancellation occurs within 3 weeks of the event date, 50% of the deposit will be refunded,

along with any other payments

-  If cancellation occurs 14 days or less from the event no refunds will be made under

any circumstances 

FINAL NUMBERS & LATE NOTICE SURCHARGE

All catering details, inclusive of final guest numbers, beverages and dietary requirements must be confirmed no later than 7 days prior to your event and will be invoiced at that time.

-  Should numbers increase or dietary changes be made, up to three business days from the event, no late surcharge will apply.

-  Should numbers increase or dietary changes be made within 2 business days from the event a late change fee of 30% of the price of the menu item will be charged, in addition to the per head charge. Please refer to our cancellations policy should numbers decrease within 14 days of the event. 

DIETARY REQUIREMENTS

Please note additional charges for dietary requests as follows:
Vegetarian – no charge
Gluten Free and Lactose free – we may charge 25% surcharge on certain menu items

STAFFING

Should staff be required for your event the following rates will apply, with a 4 hour minimum booking:
- Waiters are $30 per hour (*Additional $7 per hour surcharge applies on weekends)
- Supervisors are $40 per hour (*Additional $7 per hour surcharge applies on weekends) - Chefs are charged at a rate of $55 per hour (*Additional $7 per hour surcharge applies

on weekends) 

EQUIPMENT

Cracker Catering may be required to hire in equipment to service your event. These will form part of the quote and are in addition to any listed menu prices. Any sub hire equipment will attract the same payment conditions as outlined above. 

ACT OF GOD

If any part of the event or catering is cancelled, abandoned or postponed, in whole or in part, for any reason whatsoever that is beyond Cracker Catering’s control, including, without limitation, due to adverse weather conditions, there is no right to refund or exchange and no obligation is assumed by Cracker Catering for the arrangement of a substitute event. Under no circumstances will Cracker Catering be liable to the Client if Cracker Catering is unable to perform its obligations to the Client due to any event or cause of force majeure being any event or act beyond the control of Cracker Catering. 

ALTERATIONS TO THE EVENT

Menus may be subject to alteration without notice, due to circumstances beyond our control. Cracker Catering reserves the right to vary, add, withdraw or substitute, menu’s at any time. 

DAMAGES

Clients will assume responsibility for all damages to the property or equipment where the function is being held an shall indemnify and keep indemnified Cracker Catering, for any and all damages caused during the function by any of their guests or any other persons attending the function. 

INDEMNITY

All Clients indemnify Cracker Catering and their agents, affiliates, employees, members, promoters, volunteers and any other person or body associated with the Event against liability for or in respect of any claims, demands, actions, suits or proceedings, costs, expenses, loss, damage, personal injury or death of any person arising out of or in connection with the use of the facility
by the Client or any act or omission of the Client, or any of their guests, invitees, employees, contractors or agents, except where such claims, demands, actions, suits or proceedings, costs, expenses, loss, damage, personal injury or death of any person is caused by the negligence, any act or omission of such Cracker Catering and their agents, affiliates, employees, members, promoters, volunteers and any other person or body associated with the Event.

Nothing in these conditions of sale affects, nor is intended to affect, any rights a Client might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability for breach of any such rights is limited to supplying of the relevant goods or services again.
